Kansspelautoriteit reprimands TOTO after money laundering audit

A warning with weight. The Kansspelautoriteit (Ksa) has given TOTO Online an official instruction for breaching the Money Laundering and Terrorist Financing Act (Wwft). According to the regulator, the provider, known for operating TOTO and Winnitt, did not sufficiently monitor customers and money flows.

The intervention shows that the Ksa is further tightening its controls on licence holders. The organisation previously warned that compliance with rules around integrity and transparency must be better organised.

TOTO Online fell short in monitoring and recording

The designation came after an investigation revealed that TOTO Online did not clearly document why new facts or transactions did not lead to an adjustment of players’ risk profiles. The provider also dropped short in its investigation into the origin of money.

By law, gambling providers must constantly monitor customers’ playing behaviour. High deposits, even from one’s own bank account, can indicate money laundering risks. In the Guideline Wwft, the Ksa stresses that providers should not suffice with superficial checks.

TOTO Online cooperated with the investigation and already resolved some of the shortcomings before the designation was officially imposed. Nevertheless, the company must completely end all violations within six months. This will be followed by a re-inspection.

Stricter supervision of legal gaming providers

The case underlines that legal providers are not left out of the loop either. The Ksa previously imposed sanctions on six Dutch online casinos for misleading practices. With measures such as these, the regulator wants to show that enforcement is applied structurally and consistently, also within the licensed segment.

The warning to TOTO Online is thus more than a slap on the wrist. It is a signal to the entire sector: compliance with the Wwft is not a formality, but an obligation to ensure the integrity of the gambling market.
