BetCity must pay out €172,000 jackpot after lost court case

A Dutch woman has won a court case against online casino BetCity. She will still be paid the jackpot of over €172,000. The casino had previously refused to transfer the amount.

The woman won the jackpot on 2 July 2023. The following day, BetCity launched an investigation. The company believed her account was also being used by her ex-partner.

BetCity closed the woman’s account and kept the winnings

After about a month, BetCity completed the investigation. The outcome: the account had allegedly not been used according to the rules. The woman was told that she would not receive the jackpot. Her account was also closed.

According to BetCity, suspicious bets had been placed on unknown foreign leagues. Such bets usually came from experienced players, according to the company.

Woman’s ex-partner named as possible user

The woman’s ex-partner was at the time registered in Cruks, the system for excluded gamblers. He could therefore no longer gamble himself. Yet BetCity thought he had played anyway via his ex’s account.

The company based that on several details. For instance, both accounts were logged in quickly, almost simultaneously. Money was also attempted to be deposited from an account in the ex-partner’s name.

The woman explained the situation during the trial

The woman acknowledged that she had been in a relationship with the man. He had helped her create the account, but she claimed she had always played by herself.

One of the suspected bank accounts turned out to belong to her seven-year-old son. She was in charge of that account. The woman said the deposit was accidental. Of a deposit from her ex’s account, she knew nothing.

Judge found woman’s explanation credible

According to the judge, BetCity had not provided hard evidence that the woman had shared her account. There was no clear link between the behaviour on the account and her ex-partner.

Moreover, BetCity’s general terms and conditions were not clear about account sharing. The court found that the woman was entitled to the jackpot payout.

BetCity must still pay out the jackpot and additional costs

The judge forced BetCity to pay out the remaining €172,000.13. The company also had to reimburse extrajudicial costs of more than €3,000.

The woman can now count on the profits she was denied for almost a year. BetCity is left with reputation damage.
