Gaming Commission warns providers about ban on bonuses and gifts
The Belgian Gaming Commission (KSC) has informed online operators that an inspection has shown that a number of them are not adhering to the rules regarding the ban on gifts and bonuses. The Gaming Commission warns that violations will be severely punished.
Prohibition confirmed by Council of State
There has been legal uncertainty for some time about the applications of offering gifts and bonuses, but in January 2024 the Council of State confirmed the case law of the Gaming Commission in a judgment that it does indeed apply online and offline. The prohibition as laid down in Article 60 of the Gaming Act prohibits operators from offering free travel, meals, drinks or gifts to their customers.
Exception for land-based casinos class I.
An exception only applies to customers of class I physical gaming establishments. They may receive a maximum of 400 euros per two months and per player in gifts and bonuses.
Strict controls during the European Football Championship and the Olympic Games
The Gaming Commission will closely monitor compliance with the ban on gifts and bonuses, especially during the upcoming European Football Championship and the Olympic Games. They indicated in the letter that the Gaming Commission’s Control Cell will pay extra attention to this and will take action if violations are observed.
Informative note from KSC about bonuses and gifts
On April 18 2024 the Gaming Commission (KSC) published an informative note on its website about the offer of bonuses and gifts by operators. However the KSC notes that permit holders are not adhering to the rules set out in this memorandum and will therefore take action.
Immediate discontinuation of bonuses and gifts
The Gaming Commission calls on all online operators to take their responsibility and immediately comply with the ban. The Gaming Commission points out that violations are punishable and can lead to administrative sanctions and administrative fines.
Compliance confirmation required
The Gaming Commission requests all online operators to confirm by return, no later than May 13, 2024, that they have ceased all actions related to offering bonuses and gifts.
