Baden-Württemberg opens the doors to online gaming
Baden-Württemberg in Germany has taken a crucial step by legalising online gambling, specifically table games such as blackjack and roulette. The legal framework driving legalisation
The regulation of online table games in Baden-Württemberg is part of the Interstate Treaty on Gambling, which came into force in 2021. This treaty allows the German states to determine their own rules for online gambling. Baden-Württemberg’s recently adopted legislation aims to regulate the supply of games such as blackjack and roulette, which were previously unregulated in this Land. The aim is to offer players a legal alternative while limiting the risks associated with unauthorised operators.
This legislation comes after growing awareness of the dangers of illegal gambling sites. Without a legal alternative, residents were in danger of turning to unregulated offshore platforms, exposing the public to dubious practices.
With a population of over 11 million and a dynamic economy, Baden-Württemberg is a key player in Germany. By legalising online casino gaming, the state hopes to attract investment, create jobs and combat illegal operators. By regulating the sector, the Land also intends to put an end to the inconsistency between the country’s different regions, some of which have already authorised this type of gambling.
Tailor-made taxation for operators
One of the most remarkable aspects of this new regulation is the introduction of a progressive tax system for online casino revenues. The model adopted provides for :
- 15% tax on monthly revenues of up to €300,000
- 20% on income between €300,000 and €750,000
- 25% on revenues in excess of €750,000
The aim of this system is to ensure fair taxation while supporting the development of the industry within a controlled framework. It also enables the Land to generate tax revenue while protecting consumers and reducing the risk of gambling addiction.
Regulation of the German gambling market
Germany remains one of the most strictly regulated online gambling markets in the world. In addition to the introduction of online casino games, there are numerous restrictions. Players must adhere to strict limits: a maximum bet of €1 per slot machine spin, a five-second delay between each spin, and a monthly deposit limit of €1,000 for each player. Strict conditions which, according to some critics, encourage players to turn to unregulated platforms.
This extremely restrictive framework is at the heart of the debate in Germany, with some operators and players believing that these rules are driving players to seek out riskier alternatives. The attraction of the black market could well call into question the effectiveness of the measures adopted.
